INFORMATION ON THE PROCESSING OF PERSONAL DATA

(arts. 13 and following European Regulation 679/2016)

The purpose of this information is to describe the methods of managing the site with reference to the processing of personal data of visitors who consult it. This information is provided pursuant to art. 13 of European Regulation no. 679/2016 (regulation for the protection of personal data in member states) to those who connect to the site gaudioott.com

The user's personal data, provided to Gaudio OTT following consultation of the site itself or the request for services provided by the platform, are used by Gaudio OTT in compliance with the privacy protection principles established by the European Regulation and other current regulations on the matter.

1. Data Controller

The Data Controller is Andrea Corsi, VAT number 02101420434.

Any Data Processors will be appointed, at the time of conferment by the Data Controller of external assignments for the performance of which it is necessary to share the Customer's data, for the sole purposes connected to the contracts/relationships possibly in place between the parties, among those who present sufficient guarantees to implement adequate technical and organizational measures so that the processing meets the requirements of the Regulation and guarantees the protection of the rights of the data subject and after signing by the Data Processor of a specific contract/addendum to the professional assignment containing the requirements and specifications of the processing itself.

2. Purpose and legal basis of processing

The purposes of the processing to which the user's data are destined are:

  1. fulfillment of pre-contractual and contractual relationships in place between the parties and compliance with laws and legal obligations to which the Data Controller is subject (by way of example: registration to the site, request for advice, request for quotes on platform services, customer assistance);
  2. further and different purposes compared to contractual ones (marketing on platform services, sending newsletters to the interested party).

For the pursuit of the purposes referred to in point a) the processing of the interested party's personal data is necessary and the consent to it is fulfilled directly in the conferment of assignment.

For the processing of the interested party's data concerning further purposes compared to the pre-contractual/contractual ones referred to in point b) the express consent of the interested party is required, provided either in paper or electronic form by the same.

3. Conferment and mandatory or optional nature of data

The personal data requested are exclusively those necessary for carrying out the user's request, in full compliance with the principles of adequacy of processing sanctioned by the European Regulation. They are therefore mandatory as they are strictly functional to the execution of the services requested by the user.

In particular:

  • Last name, first name, email, password for site registration.
  • All data necessary for the execution of services provided by the platform.

Said data, with prior express consent provided in the aforementioned manner, may also be used for the further purposes referred to in letter b) of the previous point.

Each user has the right, directly from their personal area of the site, to modulate their consent (for purposes other than contractual ones) at any time.

4. Methods of processing

The processing and storage of data will be carried out with the aid of automated computerized and/or paper means and tools, such as to allow the user/customer access to their personal data in our possession, according to the most suitable methods to guarantee their integrity, updating, security and confidentiality, also protecting them from unauthorized and/or illegal processing as well as from loss, destruction or accidental damage.

Without prejudice to communications that are made in compliance with legal obligations, the data may be communicated to external parties who carry out specific assignments on behalf of the undersigned after their express commitment to the protection of your personal data in accordance with the provisions of this Information and the rules on the Data Processor referred to in arts. 28 and following of EU Regulation 679/2016, as well as the applicable legal provisions.

5. Duration of processing

The processing of data will necessarily take place for the entire duration of the relationships established between the parties and, after the conclusion of the relationship/contract in place, to comply with the legal requirements of a civil and tax nature applicable to the relationship in place, as well as any other legal requirement/obligation to which the Data Controller is bound with regard to the services referred to in point a) while, for the services referred to in point b) subject to express consent, it will take place until such consent is revoked by the data subject.

6. Rights of the data subject

At any time the data subject may exercise, with written request, towards the Data Controller identified above, all the rights recognized by the applicable European and internal legislation and in particular from articles 13, 14, 15 to 22 and 34 of the European Regulation and from the national legislation in force, and in particular:

  1. the right to obtain confirmation of the existence or not of data concerning you, even if not yet registered, and their communication in intelligible form, the right to obtain free access to and/or copy of your personal data subject to processing with the indication of all relevant aspects of the processing provided for by the EU Reg.
  2. the right to obtain free updating, rectification of inaccurate data, limitation of processing or, when interested, integration of data
  3. the right to oppose, in whole or in part, the processing of personal data concerning you even if relevant to the purposes of collection for legitimate reasons or to revoke, in whole or in part, your consent, where it is necessary
  4. the right to lodge a complaint with a supervisory authority (Data Protection Authority) or judicial authority;
