User

Natural or legal person who accesses and uses the services available on the gaudioott.com website.

1. Subject Matter

This document governs the relationship between the Service Provider and the User regarding the provision of objective analysis services through interactive and static charts on financial markets, available at https://gaudioott.com.

2. Acceptance of Terms

  • The User declares that they have read, understood and accepted these Terms and Conditions in a binding manner.
  • Access to the site and use of the Services constitute full and unreserved acceptance.

3. Service Description

Real-Time Charts

  • Most charts are updated in real-time, with minimal latency.
  • Online viewing via browser, with zoom, filter and time series navigation functions.

Advanced Charts and Updates

  • Some advanced analysis charts (e.g. proprietary indicators) are updated at the platform's discretion with improved and more performant versions.

No Data Export

  • Downloading or exporting the data underlying the charts (PDF, CSV, XLS, etc.) is not permitted.
  • All charts are accessible exclusively in visual mode within gaudioott.com
  • Their distribution is not permitted.

Data and Development Providers

  • Real-time market data is provided by official APIs from major Exchanges.
  • All datasets, metrics and advanced indicators used to generate charts—including proprietary ones—are entirely developed by the Gaudio OTT team.

4. Access and User Obligations

  • Registration requires creating an account with personal credentials (email and password).
  • The User is responsible for safeguarding these credentials and for any activity carried out with their account.
  • It is prohibited to use bots, scripts or scraping techniques, as well as to reverse-engineer the dashboards.
  • Any illegal activity or activity that compromises the security of the site will be prosecuted according to law.

5. Intellectual Property

  • All charts, software, layout, texts and proprietary datasets published on gaudioott.com are the exclusive property of Andrea Corsi.
  • The User obtains a non-exclusive, non-transferable and revocable license for viewing on the site only.
  • Any reproduction, modification, redistribution or commercial use of the content without written authorization from the Service Provider is prohibited.

6. Prices, Payments, Renewals and Right of Withdrawal

Information regarding prices, pricing plans, payment methods and subscription duration is available in the Pricing/Plans section of the gaudioott.com website, which forms an integral part of these Terms and Conditions. The service provider reserves the right to modify prices and pricing plans at any time, at its own discretion. Any changes will not affect subscriptions already active until the next expiration or renewal.

Subscriptions provide for automatic renewal at the end of the selected billing period. Renewal occurs automatically and does not require new authorization from the user.

Pursuant to art. 59, paragraph 1, letter o) of the Consumer Code, the user acknowledges and accepts that, as this is the provision of digital content and/or digital services delivered immediately, the right of withdrawal is excluded once the execution of the service has begun.

The user, upon completion of registration and acceptance of these Terms and Conditions, expressly requests immediate activation of the service and acknowledges the consequent loss of the right of withdrawal pursuant to art. 59 of the Consumer Code.

All payments made are final and non-refundable, either in whole or in part, for subscription periods already paid for and not used, except exclusively for cases provided for by mandatory legal provisions.

The user can cancel the subscription at any time independently by accessing their personal account and the Plan section. Cancellation will prevent the next automatic renewal and will take effect at the end of the current billing period, without the right to refunds for the period already paid.

7. Disclaimer and Limitations of Liability

  • The Services are provided "as is" and "as available", without any guarantee of accuracy, completeness or timeliness.
  • The graphic information and market data do not constitute financial advice in any case; any investment decision is at the exclusive risk of the User.
  • In no event shall the Service Provider be liable for direct, indirect, consequential damages or loss of profit arising from the use or inability to use the Services.

8. Processing of Personal Data

The Service Provider undertakes to process Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR). For details on purposes, legal bases and data subject rights, consult the Privacy Policy available on gaudioott.com.

9. Changes to Terms and Conditions

The Service Provider reserves the right to update these Terms and Conditions at any time. Changes will be effective from the time of online publication and, if relevant, communicated via email or notification on the site.
